The government has revealed that it will issue all funds allocated to the Constituency Development Fund (CDF) kitty, immediately a case lying in Court, seeking to block MPs from getting the funds, is heard and determined.
Devolution and Planning Cabinet Secretary Mwangi Kiunjuri has called for immediate ruling on the case, to prevent incidents where MPs will use all the first remitted CDF allocations as directed by the Court, and end up stalling projects in Constituencies, waiting for the remaining funds.
Kiunjuri said the government has no issues with releasing the funds, provided they are used to better Kenyans lives.
The High Court directed Treasury Cabinet Secretary Henry Rotich to release Sh25 billion to the Constituency Development Fund, until a case seeking to compel the government from releasing Sh35 billion to the CDF kitty, is heard and determined.
While issuing the ruling, Justice Joseph Onguto proposed formation of a three-judge bench to hear and determine the case, that was filed by Constitution Activists Wanjiru Gikonyo and Cornelius Oduor.
The two argue that the continuous existing of the CDF is unconstitutional and should be scrapped, for it forms a third level government in constituencies after County governments and the national government, contrary to the Devolution system of governance.
MPs have since remained put and vowed to stand by CDF.
